<p>Michael Boldin and Lesley Swann cover the news of the Tenther Movement &#8211; NDAA nullification on Jan Brewer&#8217;s desk, local activism and election strategies. <p><strong>Tom Woods</strong> returns to Tenther Radio in the 4th segment to talk education. He doesn&#8217;t just talk about how the education system in this country is bad, which we all know &#8211; but he’s building a new project that could help develop a model to beat the government school system&#8230;and do an end-run around the establishment.</p>
<p>&#8220;I am going to use the internet to go over the heads of a lot of these professors and I&#8217;m going to teach people real American History.  With people I trust like Kevin Gutzman, we are going to teach real history, real economics , and where people can find the time?  They can learn in their car. You can just get the stuff from our site.  You can put it in your car and drive around.&#8221;</p>
<p><strong>Paul Armentano</strong> from NORML is back on the show in the 2nd segment to talk about how Obama broke his promise to his base and has been extremely aggressive on medical marijuana in the states. But there appears to be some good news on that front too, primarily in Connecticut.<span id="more-914"></span></p>
<p>He talked talked about how Obama has backtracked on his earlier positive position on medical marijuana since he has started using the full weight of the federal government to harass medical marijuana providers and lawmakers.  He stated, &#8220;They have in some cases have actually gone after lawmakers.  They are actually threatening public officials of who simply were supportive of these programs and laws of their states.  It was too long ago where the US Attorney targeted Delaware.  Which recently passed medical marijuana legislation and where the state was about to begin licensing producers and distributors of medical marijuana.  The US attorney on behalf of the administration went to the governor of Delaware and said, &#8216;if you guys actually implement this program as the regulations are set under the law we will go after you.&#8217; and then the government immediately suspended the program.&#8221;</p>
<p>He added, &#8220;The federal government through the DEA and DOJ are using law enforcement resources that target, to raid, to arrest, and to federally prosecute individuals who are growing or distributing marijuana in these states which these activities under state law.&#8221;</p>
<p>When asked if other states are considering passing medical marijuana laws, Armentano answered, &#8220;Connecticut this fall will become the seventeenth state to enact medical marijuana legislation.  There is a medical marijuana proposal in the state of New Hampshire that has actually passed both the Senate and the House, and it needs to go back to the Senate for a concurrence vote.  There is no doubt in my mind that both chambers in New Hampshire will pass this bill.  The question is, &#8216;What would the governor do?&#8217;&#8221;</p>

<p>Michael Boldin closes the show with a rebuttal to a neocon attack in the Washington Post.</p>
<p><strong>QUOTES:</strong><br />
Referring to the Wall Street Journal piece, Nick Hankoff chimed in, &#8220;They are against the left/right paradigm might work together at all.  They want bi-partisanship in Washington DC.  They don&#8217;t want actual real grass roots coalitions down working at the bottom.  The point is that they are hypercritical and contradictory in every single way.&#8221;<span id="more-901"></span></p>
<p><strong>Guest- Eddie Allen:</strong></p>
<p>Eddie Allen replied to Jason Rink&#8217;s wardrobe suggestions, &#8220;I don&#8217;t think I&#8217;m the night club stud that Jason Rink is.&#8221;</p>
<p>When asked about what is going on grass root about money, Allen replied, &#8220;I spoke this last year at the Utah Monetary Summit.  The message there is and the drum that I&#8217;m beating is that gradually that the elected employees move their state more in compliance with the US Constitution.&#8221;</p>
<p>Referring to people using gold and silver, Allen added, &#8220;They are utilizing  those to protect themselves to all the damage that is being done to the dollar.</p>
<p>When asked which is better between gold and silver, Allen answered, &#8220;In my personal opinion, I think there is a lot of upside to silver, and I am sure that gold is way under valued.&#8221;</p>
<p><strong>Roundtable:</strong></p>
<p>Hankoff explained the differences between SOPA and CISPA by saying, &#8220;SOPA was the Stop Online Piracy Act.  CISPA is more about anti-terrorism.  Not necessarily anti-piracy, but anti-terrorism.&#8221;</p>
<p>Hankoff later added, &#8220;Your political speech is going to be judged as terrorism.  How close to terrorism is this speech?&#8221;</p>
<p>Jason Rink commented, &#8220;It is not hard to see where consumption of media on the internet is going.  It&#8217;s taking everything over.  People are going there as the primary go to source for information, news and opinion to be informed about things.  This is a dangerous precedent and not a road we want to go down.&#8221;</p>
<p>The conversation shifted from CISPA to the TSA.  Boldin referred to the criticism TAC receives from the Heritage Foundation, &#8220;They were talking about how some politician or somebody saw their 79 year old grandmother getting basically raped by the TSA, and they were disgusted.  The Heritage Foundation viewpoint is, &#8216;Well, we just need to reform it.&#8217; I mean they will never go all the way and bring up the idea that we don&#8217;t want reform the TSA, it shouldn&#8217;t exist.&#8221;</p>

<p>Michael Boldin and Lesley Swann cover some big news in the Tenther Movement.  Arizona is on the verge of becoming the 2nd state to reject NDAA, and the Missouri House just approved Constitutional Tender by a wide margin.</p>
<p>They also talk about a few upcoming events &#8211; in MA and CA over the coming week.</p>
<p>The first guest of the show, Arizona State Senator Sylvia Allen.  She&#8217;s the prime sponsor of SB1182 there, the anti-NDAA bill which just passed the house and senate &#8211; and is awaiting a signature from Jan Brewer.</p>
<p><em>&#8220;This state and any agency of this state shall not provide material support or participate in any way with the implementation of sections 1021 and 1022 of the National Defense Authorization Act of 2012,  Public Law 112-81, against any citizen of the United States.&#8221;</em></p>
<p>When Senator Allen was asked what motivated her, she responded, &#8220;It was to try to protect the due process protections in our Constitution for the citizens of the United States.&#8221;<span id="more-893"></span></p>
<p>Allen discussed some of the drama surrounding the bill, &#8220;I think the part of the bill that was more controversial for the different legislators was the part that said that law enforcement participated in arrested someone in those sections of the NDAA that they would be guilty of misdemeanors and they had problems putting that kind statements inside the bill.&#8221;</p>
<p>When she was asked about the partisanship that appears to be happening in Arizona compared to other states, &#8220;The Senate Democrats as well as the House are extremely progressive, and I would even say Marxist in some ways.  They tend to stick together.  If their leadership decides they are not supporting something, it is very rare to someone to step outside of that and join us on any issue.</p>
<p>Allen later expressed her concern about whether or Governor Brewer will sign the bill or not, &#8220;1182 is now ready for the governor to sign it.  I&#8217;ve talked to her staff.  I have talked about this bill and told them that Virginia passed a bill similar to this.  I can&#8217;t tell you what I think our governor would do.  It is hard to know.  And I am holding my breath.&#8221;</p>
<p>Also joining the show from Arizona, Jack Biltis.  He’s personally funding a statewide ballot initiative to create a mechanism for reviewing the constitutionality of federal laws &#8211; and interposing against them when needed.</p>
<p> &#8220;We are purposing an amendment to the Arizona Constitution. It will be an initiative on the November 6th ballot.  What it does in a nutshell is gives the people of Arizona checks and balances against the Federal Government from overstepping their Constitutional boundaries.&#8221;</p>
<p>When Biltis was asked about polling on his initiative, &#8220;When people understood what you were talking about &#8211; we had support, obviously Republican and independents and even among Democrats.</p>
<p>He later added supportive poll figures, &#8220;Thirty percent of Democrats, upwards to seventy percent Republicans, and sixty-five percent of independents are polling in favor of this effort.&#8221;</p>
<p>When asked the current status of signature collection for the ballot initiative, Biltis answered, &#8220;We have to collect a total of two hundred and seventy thousand signatures between now and July 5th.  And we are pretty much on schedule to collect everything.&#8221;</p>
<p>Closing the show, Boldin shared an open letter to Jan Brewer &#8211; the time to stand up for the Constitution is now.</p>

<p>Michael Boldin and Jason Rink are joined by Rob Natelson for a special lesson on writ of habeas corpus.</p>
<p>Before Rob get on the air, Rink and Boldin talk about some of the basics of liberty and how throwing money at the welfare problem has neither reduced poverty nor made the poor self-sufficient.  Since yesterday was &#8220;tax day&#8221; they also talk about a classic article written by Harry Browne nearly 10 years ago &#8211; Freedom from the Income Tax.</p>
<p>When asked about the Founders&#8217; view on Writ of <em>Habeas Corpus</em>, Rob Natelson answered, &#8220;The Founders thought the Writ was very important. They have used it themselves with their struggle against the Crown for example.  However, there was also a recognition that a power to declare war, the legislature could suspend the Writ of Habeas Corpus.  The legislature could make the decision that generals in the field or the commander in chief could lock people up for the duration without those people to go to court.&#8221;</p>
<p>He continued, &#8220;Because it was an incident in the right to declare war, Congress as the entity that would declare war under the Constitution had the right to suspend the writ. However in Article I: Section 9 under the Constitution, the Founders said that it could only be suspended under certain circumstances in case of insurrection or invasion when the public safety requires it.&#8221;<span id="more-882"></span></p>
<p>When asked how would define an invasion, Natelson answered, &#8220;Invasion involves armed incursion.   One could say that the attacks of 9/11 were an invasion.  Although, I don&#8217;t think it could justify suspension of the Writ of Habeas Corpus today.&#8221;</p>
<p>Natelson was later asked about how does the provisions in the NDAA affect the Writ of Habeas of Corpus.  He answered, &#8220;I think it is a serious issue.  I think it is Unconstitutional, and I find it distressing that some members of Congress who like to talk about the Constitution voted for this thing.&#8221;</p>
<p>When asked various instances where Habeas Corpus has been suspended, Natelson answered, &#8220;Probably the most notorious instance of mass incarceration of American Citizens would be the incarceration of Japanese Americans by the Roosevelt Administration.&#8221;</p>
<p>Natelson later explained the problem with perceived threats, &#8220;These things generally happen as a perceived threat at the time when the perception seems reasonable to many people.  What we have to understand is that we have Constitutional guarantees to protect us from that type of mass hysteria.   To protect us from ourselves when we want to do things that we shouldn&#8217;t be doing.&#8221;</p>

<p>Michael Boldin and Nick Hankoff give updates on NDAA resistance in states around the country, share news on events in Missouri and Philly &#8211; and more.  </p>
<p>Yesterday, the Tenth Amendment Center co-hosted a media conference call to update reporters on state and local resistance to the NDAA.  One of the speakers, Green Party member, Progressive &#8211; Fairfax, CA town councilor &#8211; Larry Bragman &#8211; might have made the best statement possible on how to deal with the NDAA</p>
<p><em>&#8220;I think anybody who takes the oath of office in this country as an elected official has got to do what they can do to reverse, oppose and resist this bill, and that’s what we’re doing in Fairfax.&#8221;</em></p>
<p>Joining the show as a guest to talk about that media call &#8211; Blake Filippi, of the Rhode Island Liberty Coalition, and spokesman for the TAC during the event.</p>
<p>When asked about the states responses to the Fugitive Slave Acts, he mentioned, &#8220;The State of Rhode Island passed the personal liberty law, and essentially nullified the Fugitive Slave Act.  It forbade judges recognizing claims, it extended trial by jury, and provided habeas corpus to the slaves.&#8221;  He continued, &#8220;Massachusetts went so far that federal officials who took slaves through the Fugitive Slave Act called it kidnapping. &#8221;</p>
<p>Filippi also pointed out how the Supreme Court supported the Fugitive Slave Acts, &#8220;The Dred Scott case decision passed basically said the black people are not citizens and don&#8217;t have any rights.&#8221;</p>
<p>When asked about the trends on nullifying the NDAA, Filippi responded, &#8220;I got to give my hats off to Cherokee County, Kansas.  They passed the Liberty Preservation Act in all three steps.  They told the military that is basically illegal for you to come in here and arrest and detain while pursuing 1021 and 1022 of the NDAA.&#8221;<span id="more-824"></span></p>
<p>When asked about what he thinks about the future of nullifying attempts of the NDAA, Fillippi answered, &#8220;I just see it growing.  The more states that passes just legimitzes the movement.  Other states will look at it and say, &#8216;Our sisters states just passed this, then okay.&#8217; &#8221;</p>
<p>Referring to how the Federal Government is a bully and when the states do stand up to them, Filippi said, &#8220;They have a spine of a jelly fish.&#8221;</p>
<p>Later in the show, Nick Hankoff discussed the his efforts to make his generation the Nullification Generation by speaking at events.  He mentioned during the show, &#8220;Nullification is a muscle that Constitutional theory grants us.  It is this muscle we have not used in a long time.</p>
<p>Closing out the show, Boldin is joined by Francisco Rodriguez who talks about his new project in Florida, Liberty Candidates 2012.</p>

<p>Michael Boldin and Jason Rink kick off the show talking about two new bills from Congress &#8211; HR347 and HR5 &#8211; the former on new &#8220;protest&#8221; laws and the latter on republicans pushing for mandates on the states in a big way while claiming to work on a repeal of part of Obamacare.</p>
<p>Jason Rink commenting on Special  National Security Events, &#8220;These are events where the Secret Service are involved in any way.  You could have no knowledge that there is Secret Service present like at the Superbowl.  Even if you have no knowledge that the Secret Service is there, and after all, they are Secret Service.  This type of event is one where you have very limited options in exercising your free speech and protesting and it can be a Federal crime.</p>
<p>The first guest on the show was Pat Carmack &#8211; producer of the documentary, The Money Masters.<span id="more-814"></span></p>
<p>When asked about how much is really known about the Federal  Reserve, Carmack answered, &#8220;It is a complex subject, and it has been deliberately made very complicated.  The major banks has long controlled the American Economic Associaton.  The hiring of economic professors in major universities throughout the United States to make sure that all students learn is gobbledygook.&#8221;</p>
<p>Carmack continued by saying, &#8220;The whole international economic system is deliberately complicated.  Why is that?  They want to hide what the major international banks are doing.  The reason why is because it is incredibly unjust.  They are conslidating wealth at an incredibly fast rate, and almost all of the economic crisies you see are part of that process.  They are not accidental.&#8221;</p>
<p>When asked about the Federal Reserve being either an independent, government or private entity, Carmack answered, &#8220;It is quasi-governmental.  It has certain features of a government entity, and certain features of a private entity.  For instance, it is a stock corporation.&#8221;  He continued later by explaining, &#8220;Five major banks controls sixty-one precent of the stock.  It won&#8217;t surprise you to know those: Bank of America, JP Morgan Chase, Citigroup, Wells Fargo and Goldman Sachs.&#8221;</p>
<p>Carmck referring to Ron Paul, &#8220;He has done a marvelous job and needs to highly commended.  For bringing the attention of the American public to the real villain which are the banks that control the Fed.  (Federal Reserve)&#8221;</p>
<p>Ken Ivory, state representative from Utah, also joined Rink and Boldin, primarily for a discussion on what&#8217;s being done in his state to regain control of federally-&#8221;owned&#8221; land.</p>
<p>Ivory said, &#8220;If you look at a map of Federal Land holdings.  If you go east to west, there are very little Federal Land. In fact, only four precent of the state land is Federally held land up to the east edge of Colorado.  From the eastern edge of Colorado west, is fifty percent, and Utah is sixty five percent controlled by the Federal Government.</p>
<p>Ivory gives example of the problem, &#8220;There are about two thousand oil and gas leases in eastern part of Utah that just have been sitting on a beauracrat&#8217;s desk that represents two and half billions dollars of immediate revenue for the state which is just sitting there!&#8221;</p>
<p>Ivory also discusses his Bill Transfer of public lands act, &#8220;We set a deadline.  It is set for December 31, 2014 for the Federal Government to honor it&#8217;s promise to dispose of the land and to do it now through an Utah Lands Commission.&#8221;</p>
<p>At the close of the show, Boldin shares some perspective from TAC research analyist, Derek Sheriff, who writes about some alarming statements made of late by Defense Secretary Leon Panetta.  Did the founders envision the executive branch not &#8220;needing&#8221; to come to Congress for approval of offensive military acts?</p>

Would it, could it, should it be the NDAA issue that brings everyone together?</p>
<p>At the YouTube channel TomWoodsTV Tom Woods says Demand Progress, a liberal political action group, is very comfortable signing onto a coalition finding ways to nullify NDAA’s kidnapping provisions. And Bryce Shonka, Deputy Director of TAC led a conference call with Bruce Fein, Matt Shay, and Naomi Wolf TAC and Bill of Rights Defense Committee for the media. Shonka reports that “Two groups started off never having to work together before” and then putting “together a really good product.”</p>
<p>This very Tenther Radio Blog was being typed by Nick Hankoff when Host Boldin asked for an update on this tenther’s day so far. This writer just happened to take a tour of the Los Angeles branch of the Federal Reserve two hours prior.<span id="more-804"></span></p>

<p>Robin Koerner, Huffington Post blogger responsible for <a href="http://www.huffingtonpost.com/robin-koerner/monetary-policy_b_1270711.html">the squeak of freedom on that site</a> joined the show as the first guest. He says “people are so ready for what’s not just the Donkey-Elephant game.” <a href="http://twitter.com/rkoerner">Koerner</a> quipped “Let’s try less Capitolism and more capitalism.”</p>
<p><a href="http://senate.mo.gov/nieves">Brian Nieves</a>, state senator of Missouri, was the second guest. He wants tenthers to “stand up and say we are a sovereign state. We are not going to have our constitutional rights abused by this out of control federal government.” Watch for him in the news around his bill SB 819 to stand against the National Defense Authorization Act’s 1021 and 1022 provisions. Jason Rink, writer and executive producer of <a href="http://nullificationmovie.com/">Nullification</a>, got in on the conversation of the NDAA asking if the Obama administration will actually use any restraint by not including U.S. citizens in the purview. Nieves had never heard that one.</p>
